A well-written employee handbook includes disclaimers such as the handbook is not a contract and the employer may terminate an at-will employee with or without notice or cause. When a handbook includes a progressive discipline policy and an employee is terminated without following the prescribed policy, the company may be risking a lawsuit. In Massachusetts, the courts will consider whether an employee could reasonably believe that management is bound by its policy.
